Legal Service Funds are welfare benefit funds that provide participants with legal advice and services. Benefits are usually funded with participants' contributions based on a set hourly contribution rate.
Legal benefits are usually provided by an attorney that has been retained by the Fund. The type of legal benefits covered by a Legal Service Fund is determined by the specific plan and would normally include basic legal matters such as wills and estate planning, real estate closings, and various criminal matters. Many Funds limit the number of hours covered for each type of benefit and require the participant to pay legal fees in excess of the covered benefit. Eligibility is usually based on hours worked in a specific time period. Some Funds offer benefits to retirees who have worked a predetermined number of years.
